Fungo Privacy Policy

This Privacy Policy explains how Berkeley Blvd., LLC ("we," "us," "our"), doing business as Fungo at fungohq.com and app.fungohq.com (the "Service"), collects, uses, and shares information. Berkeley Blvd., LLC is the controller of the personal information described here. By using the Service you agree to this Policy; if you do not agree, do not use the Service. Capitalized terms not defined here have the meanings in our Terms of Service.
Youth athletes: The Service is designed for adults (parents and coaches) to train young athletes, so it involves information about minors that adults provide. Please read Section 11 (Children and Youth Athletes) carefully.
1. The Personal Information We Collect

C. Information we do not intentionally collect. We do not seek health records, biometric identifiers, precise geolocation, government IDs, or financial-account numbers. Please do not include such information in free-text fields. If a query or profile incidentally contains extra detail, we treat it as ordinary request text and you may ask us to delete it (Section 10).
2. Sources of Information
We collect information (a) directly from you; (b) automatically from your device and our infrastructure as you use the Service; and (c) from our service providers (for example, subscription status from Stripe). On Coach/Club plans, a coach may provide information about players; see Section 11.
3. How We Use Information
We use the information above to:
- Provide the Service: match queries to Third-Party Content, generate weekly plans and swing feedback, track progress, and manage teams and rosters;
- Create and authenticate your Account and send sign-in links;
- Process Subscriptions, billing, and receipts (via Stripe), and enforce plan limits;
- Send transactional communications (requested drills, sign-in links, billing receipts, plan reminders) and, with separate consent, marketing email;
- Operate, secure, debug, and improve the Service, including improving how our systems classify content and match queries;
- Analyze how people navigate and use the Service (pages and screens viewed, features and buttons used) through product analytics, to understand behavior, diagnose problems, and improve the product;
- Understand aggregate demand and usage in de-identified or aggregated form;
- Comply with law and enforce our Terms.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not use your personal information, queries, or swing video/frames to train third-party AI models.
4. Artificial Intelligence and Swing Video
AI processing. To generate drill matches, plans, and swing feedback, we send relevant inputs to our AI provider, Anthropic, PBC, which processes them to return an output. For the free flow, we send only your query text (not your email). For plans, we send the problem description and non-identifying profile context (e.g., level, position).
Swing video handling. When you upload swing video, the video is processed on your device to sample a small number of still frames; those frames (not the full video) are sent to the AI provider for analysis. We do not store your uploaded video files or the extracted frames after analysis. We retain only the resulting written assessment and any progress comparison. Because a video may depict a minor, only an authorized adult may upload it (Section 11).
5. Legal Bases for Processing (EEA/UK)
Where the GDPR or UK GDPR applies, we process personal information under these bases: performance of a contract (providing the Service and Subscription you request); legitimate interests (securing, debugging, and improving the Service and measuring aggregate demand); consent (marketing email and, where applicable, processing a minor's information provided by a parent/guardian, which may be withdrawn at any time); and legal obligation (tax, accounting, and compliance).
6. How We Share Information
We share personal information only with service providers ("processors") that handle it on our behalf under contractual and posted commitments, and as otherwise described below.

We may also disclose information: to comply with law, legal process, or an enforceable governmental request; to protect the rights, safety, or property of users, the public, or Berkeley Blvd., LLC, and to enforce our Terms; and in connection with a merger, acquisition, financing, or sale of assets, in which case this Policy's protections continue to apply to previously collected data, and we will provide notice where required.
7. Cookies and Tracking
We use first-party cookies and browser local storage for two purposes: (a) essential functionality — a minimal flag to avoid double-counting a visit and to keep you signed in; and (b) product analytics through our provider PostHog, which sets a first-party identifier so we can measure how the Service is used within and across sessions. We do not use advertising cookies, third-party advertising networks, cross-site or cross-context tracking for advertising, or session/screen recording. You can limit or clear cookies through your browser settings; essential features may rely on the functional storage described above. In the EEA/UK we process product-analytics data under our legitimate interests (Section 5), and we honor Global Privacy Control as described in Section 10.
8. Data Retention
We keep personal information only as long as needed for the purposes above:

We may retain limited information longer where required for legal compliance, dispute resolution, or fraud prevention.
9. Security
We use commercially reasonable safeguards, including transport encryption (HTTPS), encryption at rest by our storage provider, passwordless authentication, server-side security rules that restrict who can read or write data (subscription and roster data are written only by our server, and one user cannot read another's data), and access controls limiting employee access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Your Rights and Choices
Everyone. You may access, correct, delete, or receive a copy of your personal information, and object to or restrict certain processing. You can edit your profile and delete plans, players, teams, and your entire Account (which cancels any Subscription and deletes your data) directly in the App (Settings → Delete account), or email nick@berkeleyblvd.com. We verify requests using the email on file and respond within the time required by law (generally 30–45 days). We will not discriminate against you for exercising a right.
Email choices. Requested drill emails, sign-in links, and billing receipts are transactional. Marketing email is sent only with separate consent and always includes an unsubscribe link.
Do Not Track / Global Privacy Control. We do not track users across third-party sites. Where legally required, we honor Global Privacy Control signals as an opt-out of "sale"/"sharing" (we do neither).
11. Children and Youth Athletes
The Service is directed to adults, not to children. Account holders must be 18 or older (see Terms Section 3). Children may not create accounts, sign in, subscribe, or use the App directly.
Because Fungo helps adults train young athletes, an adult may provide information about a minor — a name or nickname, age, level, position, and swing video. If you provide a minor's information, you represent that you are the minor's parent or legal guardian, or a coach or adult who has obtained verifiable consent from the minor's parent or legal guardian (Terms Section 4). We use a minor's information solely to provide the Service (matching drills, building plans, and generating swing feedback), and we do not use it for advertising or sell it. Our product analytics (Section 1B, Section 7) measures how the adult account holder uses the Service; because children do not sign in or use the App directly, these usage/behavioral events are attributed to the adult's account, not to a child.
We do not knowingly collect personal information directly from a child under 13 online. If you believe a child has provided information directly to us, or you are a parent/guardian who wants to review or delete a minor's information we hold, contact nick@berkeleyblvd.com or delete the relevant records in the App, and we will act promptly.
12. State-Specific Privacy Rights (United States)
California (CCPA/CPRA). California residents may have rights to know, access, correct, and delete personal information, and to opt out of "sale"/"sharing" and limit use of sensitive personal information. We collect the categories in Section 1 (identifiers, commercial/subscription information, internet activity, and audiovisual information you upload), use them as in Section 3, and disclose them to the processors in Section 6. We do not sell or share personal information as those terms are defined by the CCPA, and we do not use sensitive personal information for purposes requiring a right to limit. Authorized agents may submit requests to nick@berkeleyblvd.com; we verify via the email on file.
Other states (e.g., Virginia, Colorado, Connecticut, Texas, and similar). Residents of states with comprehensive privacy laws may have rights to access, correct, delete, obtain a portable copy, and opt out of targeted advertising, sale, and certain profiling. We do not conduct targeted advertising or sell personal information. Submit requests as in Section 10; you may appeal a denied request by replying to our response.
13. GDPR / UK Rights (EEA, UK, Switzerland)
If you are in the EEA, UK, or Switzerland, in addition to the bases in Section 5 you may have rights to access, rectification, erasure, restriction, portability, objection, and to withdraw consent, and to lodge a complaint with your supervisory authority. Because we are US-based, using the Service involves transfer of your information to the United States; where required for such transfers we rely on appropriate safeguards, including Standard Contractual Clauses with our processors.
14. International Transfers
We are based in the United States and the providers in Section 6 process data in the United States and potentially other countries. If you use the Service from outside the U.S., you understand your information will be transferred to and processed in the U.S., which may have different data-protection laws than your jurisdiction.
15. Third-Party Links
Drill emails and the Service link to third-party platforms (e.g., Instagram). Those platforms have their own privacy practices; this Policy does not apply to them. Your payments are handled on Stripe's systems under Stripe's policy.
16. Changes to This Policy
We may update this Policy from time to time. We will post the updated version at fungohq.com/privacy with a new effective date and, for material changes affecting previously collected data, provide additional notice (such as email or in-app) where required by law.
